Cambodia, formerly known as Khmer, has a record of intellectual property rights since the 1960s. Although Cambodia is not a signatory to the "Nice Agreement" nor a signatory to the "VCLT", it still follows these two classification systems. Cambodia has applied the Madrid trademark since June 5, 2015 and is a member of the Madrid Trademark Agreement.
There are two ways to apply for a Cambodian trademark: 1. Single country application; 2. Designation of Cambodia as one of the applying countries through the Madrid trademark.

Materials required for filing of trademark application in Cambodia
1. Individual application: ID card copy with front and back.
Company application: Copy of certificate of incorporation
2. Applicant's name and address with Chinese and English.
3. A clear graphical representation of the trademark
4. Classes of trademark applications and goods / services (※Nice Classification, NCL)
5. Original Power of attorney(Notarized)
Cambodia trademark application process
STEP 1. Application
After submitting the required documents, the Intellectual Property Bureau will issue an application receipt.
(※ The Intellectual Property Authority of Cambodia is called the Department of Intellectual Property Right, DIPR)
STEP 2. Formal Examination
If the application documents are missing or do not meet the legal requirements, a temporary rejection notice will be issued, and the applicant must reply within 60 days.If the applicant fail to reply before the deadline, the application will be deemed to have been withdrawn.
STEP 3. Substantive Examination
If there are any reasons for unregistrable , such as "should be declared not dedicated", the official will issue a notice of the reason for the refusal and need to reply to the review within 60 days from the date of receipt of the notice.
STEP 4. Registration and Announcement
Once it is determined that the trademark can be registered, the official will issue a notice of acceptance, at which time the applicant must pay the registration fee. Then a trademark registration certificate will be issued and the trademark will be published in the official gazette for about 3 months. This three-month period is also the period of opposition. Anyone can file an opposition to the trademark. However, the opposition procedure in Cambodia is not common, because the trademark application is only announced and accepted the objection after registration
Therefore, before registration, it is impossible to know who applied for a trademark.
※Notices:
1. After registration, the trademark owner must submit an affidavit of use / non-use within 5 years after the date of registration or renewed.
2. A trademark registration is valid for 10 years from the date of application.
